Welcome to Drift Fenland. These Terms and Conditions ("Terms") govern your use of the Drift Fenland website (the "Website") and the services provided by Drift Fenland ("we," "our," or "us"), including travel arrangements, booking services, and related products.

By accessing or using our Website, making a booking, or using our services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Website or use our services.

2. Definitions

In these Terms, the following definitions apply:

  • "Agreement" means the contract between you and Drift Fenland, which includes these Terms and any other applicable terms or conditions.
  • "Booking" means a reservation made through Drift Fenland for travel arrangements or services.
  • "Client," "you," or "your" means the person who makes a booking or uses our services.
  • "Deposit" means a partial payment made at the time of booking to secure travel arrangements.
  • "Force Majeure Event" means an event beyond our reasonable control, including but not limited to acts of nature, terrorism, war, political unrest, strikes, or changes in laws or regulations.
  • "Services" means the travel arrangements, booking services, and other products provided by Drift Fenland.
  • "Travel Documents" means passports, visas, health certificates, and other documents required for travel.
  • "Travel Supplier" means a third party that provides travel services, such as airlines, hotels, tour operators, cruise lines, and transportation companies.

3. Booking and Payment

3.1 Making a Booking

When you make a booking with Drift Fenland, you warrant that you have the authority to accept these Terms on behalf of yourself and all members of your party. If you are making a booking for other travelers, you are responsible for informing them of these Terms and ensuring their compliance.

3.2 Booking Confirmation

A contract between you and Drift Fenland is formed when we issue a booking confirmation. Prior to this, any quotation given is merely an invitation to treat, not a contractual offer.

3.3 Deposits

Most bookings require a deposit to secure travel arrangements. The amount of the deposit will be specified at the time of booking. Deposits are generally non-refundable, subject to our Refund Policy.

3.4 Final Payment

Full payment for your booking is typically required 60-90 days before departure, depending on the specific travel arrangements. The exact due date for final payment will be specified at the time of booking. If final payment is not received by the due date, we reserve the right to cancel your booking and retain your deposit.

3.5 Payment Methods

We accept payment by major credit cards (Visa, MasterCard, American Express), bank transfers, and PayPal. For certain destinations, we may offer payment plans, which will be detailed separately if applicable.

3.6 Pricing and Fees

All prices are quoted in British Pounds (£) unless otherwise specified. Prices are subject to change until your booking is confirmed.

Prices may not include:

  • Travel insurance
  • Visa and passport fees
  • Vaccinations or health requirements
  • Optional activities or excursions
  • Personal expenses
  • Gratuities
  • Meals not specified in the itinerary
  • Airline baggage fees

4. Cancellations and Changes

4.1 Cancellation by You

If you need to cancel your booking, you must notify us in writing as soon as possible. Cancellation fees will apply based on the date we receive your written notification. Please refer to our Refund Policy for specific cancellation fee schedules.

4.2 Changes by You

If you wish to make changes to your booking after confirmation, we will make reasonable efforts to accommodate your request. However, we cannot guarantee that changes will be possible. An administration fee of £50 per person per change may apply, in addition to any costs or fees imposed by Travel Suppliers.

4.3 Cancellation or Changes by Us

In rare circumstances, we may need to cancel or make significant changes to your booking. If this occurs, we will notify you as soon as possible and offer you the following options:

  • Accept the changes and the revised price
  • Choose an alternative travel arrangement of comparable standard, if available
  • Cancel your booking and receive a full refund of all monies paid

We will not be liable for any additional expenses incurred as a result of our cancellation or changes.

4.4 Force Majeure

We will not be liable for any failure to perform our obligations under these Terms that is caused by a Force Majeure Event. In such circumstances, we will promptly notify you and use reasonable efforts to minimize the impact on your travel arrangements. We may offer alternative arrangements, credits, or refunds at our discretion.

5. Travel Documentation and Requirements

5.1 Travel Documents

You are responsible for ensuring that you and all members of your party have valid travel documents, including passports, visas, and health certificates. You must check the requirements for your specific destinations and transit countries well in advance of travel.

Passports must generally be valid for at least six months beyond your return date. Some countries require multiple blank pages in your passport.

5.2 Health Requirements

You are responsible for complying with all health requirements and recommendations for your destinations, including vaccinations and preventive medications. We recommend consulting with a travel medicine specialist before your trip.

5.3 Travel Insurance

We strongly recommend that all clients purchase comprehensive travel insurance to protect against cancellation fees, medical expenses, and other potential losses. Drift Fenland can provide information about travel insurance options, but it is your responsibility to ensure you have adequate coverage.

6. Travel Services and Suppliers

6.1 Third-Party Suppliers

Drift Fenland acts as an intermediary between you and Travel Suppliers. The services provided during your trip are delivered by independent suppliers who have their own terms and conditions. We are not responsible for the actions or omissions of these suppliers.

6.2 Accommodation

Hotel ratings are provided as a general guide and are based on local standards, which may differ from international standards. Accommodations are subject to change due to availability or other circumstances.

6.3 Transportation

Flight times, carriers, aircraft types, and routes are subject to change. We will notify you of any significant changes as soon as possible. We are not responsible for airline schedule changes, delays, or cancellations.

6.4 Itinerary Changes

While we strive to operate all trips as described, we reserve the right to change the trip itinerary due to operational requirements, safety concerns, or Force Majeure Events. We will make reasonable efforts to provide comparable alternatives if changes are necessary.

7. Your Responsibilities and Conduct

7.1 Compliance with Laws and Regulations

You must comply with all applicable laws, regulations, and customs of the countries you visit. You are responsible for any consequences resulting from your non-compliance.

7.2 Conduct

You must conduct yourself in a manner that does not endanger, disturb, or disrupt others. Drift Fenland reserves the right to terminate your trip if your behavior is deemed inappropriate or disruptive. In such cases, you will be responsible for your own return transportation and any costs incurred, and no refund will be provided.

7.3 Special Requirements

If you have special requirements (such as dietary restrictions, mobility limitations, or medical conditions), you must inform us at the time of booking. We will make reasonable efforts to accommodate your needs, but cannot guarantee that all requests can be met.

8. Liability and Limitations

8.1 Our Liability to You

We will exercise reasonable skill and care in arranging your travel services. However, as many of the services are provided by independent suppliers, we cannot accept liability for any injury, illness, death, loss, damage, expense, cost, or other claim that arises from:

  • The acts or omissions of Travel Suppliers or other third parties
  • Your own actions or omissions
  • Force Majeure Events
  • Situations which neither we nor our suppliers could have anticipated or avoided even with all due care

8.2 Limitation of Liability

To the maximum extent permitted by law, our liability for any claim arising from your booking or use of our services is limited to the amount you paid for the affected services. We do not accept liability for indirect or consequential losses, loss of enjoyment, or loss of opportunity.

8.3 Travel Advisories and Warnings

You acknowledge that you have been advised to review travel advisories and warnings issued by your home country's government before booking travel to international destinations. Drift Fenland will not be liable for any losses or damages incurred as a result of travel to destinations for which travel warnings have been issued.

9. Complaints and Dispute Resolution

9.1 During Your Trip

If you encounter any issues during your trip, you should promptly notify the relevant Travel Supplier and our emergency contact. This gives us the opportunity to resolve problems while you are still traveling.

9.2 After Your Trip

If you have a complaint after your trip, you must submit it in writing to Drift Fenland within 28 days of the end of your trip. We will investigate your complaint and respond within a reasonable timeframe.

9.3 Dispute Resolution

In the event of a dispute that cannot be resolved through our complaint process, both parties agree to attempt to resolve the dispute through mediation before pursuing other remedies. Any legal proceedings must be brought in the courts of England and Wales, and English law will apply.

10. Intellectual Property

All content on our Website, including text, graphics, logos, images, and software, is the property of Drift Fenland or our content suppliers and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our express written permission.

11. Privacy

We collect and process your personal information in accordance with our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to our collection and use of your information as described in the Privacy Policy.

12. Website Use

12.1 Website Accuracy

We make reasonable efforts to ensure that the information on our Website is accurate and up-to-date. However, we do not warrant that the Website will be error-free or uninterrupted, or that defects will be corrected.

12.2 User Accounts

If you create an account on our Website, you are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

12.3 Prohibited Uses

You may not use our Website:

  • In any way that violates applicable laws or regulations

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts of England and Wales.
